These Terms and Conditions (“Terms”) govern access to and use of https://www.swastikspl.com (the “Website”) and the purchase of products from Swastik Spl (the “Services”). By accessing the Website, creating an account, or placing an order, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services.

We sell as an inventory / own-account e-commerce seller (not a multi-seller marketplace). Country of origin and other mandatory particulars will be shown on product pages, packaging, and/or invoices as applicable.

These Terms are intended to align with the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and other applicable Indian laws. Nothing in these Terms limits any non-waivable consumer rights.

2. Eligibility and accounts

• You must be competent to contract under Indian law (generally 18 years or older, or a duly authorised business representative).
• Checkout requires a signed-in account. Authentication is provided via Supabase using email and Google OAuth.
• You are responsible for the accuracy of account information and for safeguarding login credentials and devices.
• Session cookies/tokens may keep you signed in. Cart contents may be stored in browser localStorage.
• We may suspend or terminate accounts for fraud, abuse, chargebacks in bad faith, or breach of these Terms.

3. Products and descriptions

• Product images, colours, and descriptions on the Website are illustrative. Natural variation, screen settings, lighting, batch differences, and application methods may cause actual colour appearance to differ.
• Industrial, textile, festive, rangoli, sindoor/sacred, and packaging colours must be used only for their intended lawful purposes and in accordance with any instructions, warnings, or industry practice.
• You are responsible for verifying suitability for your end use (including compatibility, safety, and regulatory requirements applicable to your use case).
• Prices are displayed in Indian Rupees (INR) and may change before you complete payment. The price charged is the price confirmed at checkout/payment.
• Marketing language on the Website is not a third-party laboratory certification unless a specific certificate is expressly stated for a product.

We reserve the right to correct errors, withdraw offers, or refuse orders in case of obvious pricing/stock mistakes, suspected fraud, or legal restrictions.

4. Orders and contract formation

1. Adding items to cart does not create a binding contract.
2. An order is an offer to purchase.
3. A contract is formed when we accept the order after successful payment confirmation (typically via Razorpay verification) and/or when we confirm acceptance by email/Website status, subject to stock availability.
4. We may cancel an order if payment fails, stock is unavailable, information is incomplete/incorrect, or fulfilment is not reasonably possible. In such cases, a successful payment will be refunded as set out in Section 9.

You must provide complete and accurate shipping details, including a valid Indian PIN code. We ship Pan-India only.

5. Payments

• Payments are processed in INR through Razorpay (cards, UPI, net banking, and other methods Razorpay enables on our checkout).
• We do not store your full card details on our servers.
• You authorise Razorpay and us to collect amounts for your order, including applicable taxes and shipping charges shown at checkout.
• An invoice/receipt will be issued after successful payment. Tax invoice particulars (including GSTIN when allotted) will appear on the invoice.

Failed, pending, or abandoned payments do not create a confirmed sale. Do not make offline payments unless we expressly instruct you in writing.

6. Shipping and delivery

Working days exclude Sundays and public holidays observed at our premises or by carriers, unless we state otherwise.

Delivery delays caused by incorrect address, unavailability of recipient, force majeure, courier disruption, strikes, weather, or government restrictions are outside our reasonable control. Please update contact details promptly and keep your phone available for delivery attempts.

7. Cancellations

• Preferred: Request cancellation before dispatch, ideally within 12 hours of placing the order, by emailing info@swastikspl.com with your order number.
• Once dispatched, cancellation is generally not available; remedies then follow the returns and refunds rules in Sections 8–9.
• We may cancel as described in Section 4; refunds for prepaid amounts will be processed as in Section 9.

8. Returns, replacements, and non-returnable items

8.1 Quality, damage, or wrong item

Notify us within 7 days of delivery at info@swastikspl.com with:

• order number;
• clear photos/videos of the product, packaging, and label/invoice; and
• a short description of the issue.

Subject to verification, we may offer replacement, store credit, or refund at our discretion, as required by applicable consumer law for defective or non-conforming goods.

8.2 Colour powders and similar goods (generally non-returnable)

Opened, used, mixed, contaminated, or partially consumed colour powders and similar products (including dyes, pigments, gulaal, rangoli, sindoor/sacred colours, and packaging colours) are generally non-returnable for change of mind, shade preference, or unsuitable end-use, because of hygiene, safety, and resale constraints—except where Indian consumer law requires a remedy for defect, damage in transit (when promptly reported), or wrong item shipped.

Unopened products returned without authorisation may be refused.

8.3 Return process

Do not ship returns without our written authorisation. Authorised returns must follow the instructions we provide (including address and packaging). We may inspect returned goods before approving a remedy.

9. Refunds

• Approved refunds are processed to the original payment method via Razorpay/banking rails, typically within a timeline communicated at approval (bank/display timelines may additionally apply).
• Shipping charges may be non-refundable where the cancellation or return is not due to our error or a proven defect/wrong item, unless law requires otherwise.
• Chargebacks should be raised only after contacting us; unfounded chargebacks may lead to account restrictions.

Nothing in these Terms limits non-waivable rights under the Consumer Protection Act, 2019.

10. Use of products; safety; liability limits

• Follow product instructions and applicable safety guidance. Some colour materials may stain, irritate, or be unsuitable for food, skin, children, or certain industrial processes unless expressly stated as suitable.
• You must comply with all laws applicable to storage, transport, and use of purchased goods.
• To the fullest extent permitted by Indian law, our aggregate liability for any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special, or consequential losses (including lost profits or business interruption), except where such exclusion is prohibited (including for proven deficiency in service or product liability claims recognised by law).
• Nothing excludes liability for fraud, wilful misconduct, or liability that cannot be limited under applicable law.

11. Acceptable use of the Website

You agree not to:

• misuse the Website (scraping that harms the service, introducing malware, attempting unauthorised access);
• place fraudulent orders or provide false information;
• infringe intellectual property or misuse Swastik Spl™ branding;
• interfere with other users or with payment/auth systems.

We may suspend access for violations.

12. Intellectual property

Website content, branding (including Swastik Spl™), logos, product photography (except where third-party rights apply), and software elements are owned by us or our licensors. You receive a limited, non-exclusive licence to use the Website for personal/business purchasing—not to copy, republish, or commercially exploit our content without permission.

13. Privacy

Personal data is processed as described in our Privacy Policy. Processors supporting the Services include Supabase, Razorpay, Vercel, and Google (OAuth / Maps / Fonts as applicable). We do not currently use Google Analytics or ad pixels.

14. Grievance redressal (consumer / e-commerce)

Under the Consumer Protection (E-Commerce) Rules, 2020:

A named Grievance Officer will be published on this page when designated. Until then, use the title and contact above.

We aim to acknowledge consumer grievances within 48 hours and resolve them within one month of receipt (or such other timeline as applicable law requires). Escalation may be available through consumer commissions under the Consumer Protection Act, 2019.

15. Force majeure

We are not liable for delay or failure caused by events beyond reasonable control, including natural disasters, epidemics, war, terrorism, labour disputes, power/internet outages, courier failures, government actions, or supply shortages.

16. Changes to Terms

We may update these Terms by posting a revised version on the Website with a new “Last updated” date. Continued use after changes constitutes acceptance, except where applicable law requires additional consent for a material change affecting existing orders (in which case the Terms in force at purchase apply to that order unless otherwise agreed).

17. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to mandatory consumer protections, courts at Raipur, Chhattisgarh, India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.

Consumers may also avail remedies before the appropriate consumer forum as provided under the Consumer Protection Act, 2019.
